The Khmer Movement for Democracy (KMD) extends its warmest congratulations and a heartfelt welcome to Mr. Tom Andrews on his official visit and appointment as the United Nations Special Rapporteur on the situation of human rights in Cambodia.

Mr. Andrews brings a distinguished record of unwavering commitment to justice, democracy, and fundamental freedoms across the region. Having demonstrated steadfast leadership and principled advocacy for democratic governance and international law in his previous mandate concerning Myanmar, his appointment brings vital experience and energy to the mandate in Cambodia.

KMD has long maintained constructive cooperation with the Office of the UN High Commissioner for Human Rights (OHCHR) in Geneva and worked closely with the outgoing Special Rapporteur, Professor Vitit Muntarbhorn, as well as the UN Secretariat in Geneva and New York. We express our deep appreciation for the UN’s comprehensive field reports and key benchmarks aimed at strengthening the rule of law and democratic integrity in Cambodia.

Tragically, as Mr. Andrews conducts his official evaluation of fundamental freedoms in Cambodia, the Hun Manet regime continues its brazen and ruthless crackdown. Just days before this visit, 19-year-old tuk-tuk driver Chhoeurng Sovan—whose family survives on less than $10 a day—was sentenced to four years in prison and fined $1,000 on fabricated charges of “demoralizing the army” and “incitement.” His only “crime” was sharing a social media post regarding the ongoing Cambodia-Thailand border conflict. This severe injustice, unfolding simultaneously with the UN mandate’s visit and just four months before Cambodia is set to host 90 member states for the Francophonie (OIF) Summit, proves the regime’s absolute defiance of the international rules-based order. This must, and most certainly will, be noted in the Report of the Special Rapporteur to the UN Human Rights Council.

As Mr. Andrews undertakes his mission, KMD urges prioritized international attention and constructive action on three critical areas of urgent concern:

Ending arbitrary detentions and securing the immediate, unconditional release of all political prisoners—specifically including 19-year-old Chhoeurng Sovan, the 5 detained youth environmentalists of Mother Nature, prominent former activist monk Venerable Koet Saray,

and the full restoration of the political rights of opposition leaders like Kem Sokha and Rong Chhun—in full alignment with Cambodia’s constitutional guarantees and international human rights obligations.

Stopping the persistent intimidation, persecution, and legal pressure targeting opposition figures, civil society advocates, independent trade union leaders, and members of the media, particularly the weaponization of the judiciary to silence those who dare to speak out. Sovereign issues such as the Cambodia-Thailand border crisis cannot be excluded from constitutionally and internationally guaranteed freedom of expression.

Achieving full implementation of the 20 Recommendations set forth by the UN Special Rapporteur—particularly those establishing the necessary legal and political conditions for genuinely free, fair, inclusive, and credible elections. Furthermore, KMD calls upon the international community to condition its diplomatic engagement, including at the upcoming November OIF Summit, on the immediate cessation of these severe domestic abuses.

KMD stands fully prepared to cooperate with the Special Rapporteur’s mandate. We remain steadfast in supporting all principled efforts to foster peace, justice, national reconciliation, and to build a Cambodia that belongs to all its citizens, not just one ruling family, ensuring full respect for the fundamental rights and dignity of all Cambodian people.

ចលនាខ្មែរដើម្បីលទ្ធិប្រជាធិបតេយ្យ (KMD) សូមសម្តែងនូវការអបអរសាទរយ៉ាងកក់ក្តៅ និងស្វាគមន៍ដោយស្មោះអស់ពីដួងចិត្តចំពោះលោក Tom Andrews ក្នុងឱកាសនៃការបំពេញទស្សនកិច្ចផ្លូវការ និងការបំពេញតួនាទីជាអ្នករាយការណ៍ពិសេសរបស់អង្គការសហប្រជាជាតិ ស្តីពីស្ថានភាពសិទ្ធិមនុស្សនៅកម្ពុជា។

លោក Andrews មានប្រវត្តិការងារដ៏លេចធ្លោក្នុងការប្តេជ្ញាចិត្តយ៉ាងមុតមាំចំពោះយុត្តិធម៌ លទ្ធិប្រជាធិបតេយ្យ និងសេរីភាពជាមូលដ្ឋាននៅក្នុងតំបន់។ តាមរយៈការបង្ហាញនូវភាពជាអ្នកដឹកនាំដ៏រឹងមាំ និងការតស៊ូមតិដោយឈរលើគោលការណ៍ ដើម្បីការពារអភិបាលកិច្ចប្រជាធិបតេយ្យ និងនីតិអន្តរជាតិ ក្នុងអាណត្តិមុនរបស់លោកទាក់ទងនឹងប្រទេសមីយ៉ាន់ម៉ា ការតែងតាំងលោកសម្រាប់អាណត្តិនៅកម្ពុជាបាននាំមកនូវបទពិសោធន៍ និងថាមពលដ៏សំខាន់សម្រាប់បេសកកម្មនេះ។

KMD បានរក្សាកិច្ចសហប្រតិបត្តិការប្រកបដោយស្ថាបនាជាមួយការិយាល័យឧត្តមស្នងការអង្គការសហប្រជាជាតិទទួលបន្ទុកសិទ្ធិមនុស្ស (OHCHR) នៅទីក្រុងហ្សឺណែវ និងបានធ្វើការយ៉ាងជិតស្និទ្ធជាមួយអ្នករាយការណ៍ពិសេសដែលបានបញ្ចប់អាណត្តិ គឺសាស្ត្រាចារ្យ Vitit Muntarbhorn ព្រមទាំងលេខាធិការដ្ឋានអង្គការសហប្រជាជាតិ នៅទីក្រុងហ្សឺណែវ និងទីក្រុងញូវយ៉ក។ យើងខ្ញុំសូមថ្លែងអំណរគុណយ៉ាងជ្រាលជ្រៅចំពោះរបាយការណ៍វាយតម្លៃលម្អិត និងអនុសាសន៍សំខាន់ៗរបស់អង្គការសហប្រជាជាតិ ដែលមានគោលបំណងពង្រឹងនីតិរដ្ឋ និងសុចរិតភាពនៃលទ្ធិប្រជាធិបតេយ្យនៅកម្ពុជា។

ជាអកុសល ខណៈដែលលោក Andrews កំពុងបំពេញបេសកកម្មវាយតម្លៃជាផ្លូវការអំពីស្ថានភាពសេរីភាពជាមូលដ្ឋាននៅកម្ពុជា របបលោក ហ៊ុន ម៉ាណែត នៅតែបន្តការបង្ក្រាបយ៉ាងកម្រោល និងឥតញញើត។ ត្រឹមតែប៉ុន្មានថ្ងៃមុនដំណើរទស្សនកិច្ចនេះ យុវជនអាយុ ១៩ ឆ្នាំ ឈ្មោះ ឈឿន សុវណ្ណ ដែលជាអ្នកបើកបររ៉ឺម៉កម៉ូតូ និងមានគ្រួសាររស់នៅដោយចំណូលតិចជាង ១០ ដុល្លារក្នុងមួយថ្ងៃ ត្រូវបានតុលាការកាត់ទោសឱ្យជាប់ពន្ធនាគាររយៈពេល ៤ ឆ្នាំ និងពិន័យជាប្រាក់ចំនួន ១,០០០ ដុល្លារអាមេរិក ក្រោមបទចោទប្រកាន់ប្រឌិតពីបទ «ធ្វើឱ្យកងទ័ពបាក់ទឹកចិត្ត» និង «ញុះញង់»។ «កំហុស» តែមួយគត់របស់លោក គឺការចែករំលែកការបង្ហោះមួយលើបណ្ដាញសង្គមទាក់ទងនឹងជម្លោះព្រំដែនកម្ពុជា–ថៃដែលកំពុងបន្ត។ ភាពអយុត្តិធម៌ដ៏ធ្ងន់ធ្ងរនេះ ដែលកើតឡើងស្របពេលនឹងដំណើរទស្សនកិច្ចរបស់អ្នករាយការណ៍ពិសេស និងត្រឹមតែបួនខែមុនដែលកម្ពុជាត្រៀមធ្វើជាម្ចាស់ផ្ទះនៃកិច្ចប្រជុំកំពូលអង្គការអន្តរជាតិប្រើប្រាស់ភាសាបារាំង (OIF) ដែលមានការចូលរួមពីប្រទេសសមាជិកចំនួន ៩០ បង្ហាញយ៉ាងច្បាស់ពីការបដិសេធទាំងស្រុងរបស់របបនេះចំពោះសណ្តាប់ធ្នាប់អន្តរជាតិផ្អែកលើច្បាប់។ ករណីនេះត្រូវតែ និងប្រាកដជានឹងត្រូវបានកត់ត្រានៅក្នុងរបាយការណ៍របស់អ្នករាយការណ៍ពិសេសជូនក្រុមប្រឹក្សាសិទ្ធិមនុស្សអង្គការសហប្រជាជាតិ។

ក្នុងអំឡុងពេលលោក Andrews បំពេញបេសកកម្មនេះ KMD សូមអំពាវនាវឱ្យសហគមន៍អន្តរជាតិផ្តល់អាទិភាព និងចាត់វិធានការប្រកបដោយស្ថាបនាលើបញ្ហាបន្ទាន់ចំនួនបី ដូចខាងក្រោម៖

១. បញ្ចប់ការឃុំខ្លួនដោយបំពានច្បាប់ និងដោះលែងអ្នកទោសនយោបាយទាំងអស់ជាបន្ទាន់ ដោយគ្មានលក្ខខណ្ឌ ជាពិសេសរួមមាន យុវជនអាយុ ១៩ ឆ្នាំ ឈ្មោះ ឈឿន សុវណ្ណ យុវជនចលនាមាតាធម្មជាតិទាំង ៥ រូប ព្រះតេជព្រះគុណ កើត សារ៉ាយ អតីតសកម្មជនព្រះសង្ឃដ៏លេចធ្លោ ព្រមទាំងស្ដារឡើងវិញនូវសិទ្ធិនយោបាយពេញលេញរបស់មេដឹកនាំគណបក្សប្រឆាំងដូចជា កឹម សុខា និង រ៉ុង ឈុន ស្របតាមការធានារបស់រដ្ឋធម្មនុញ្ញកម្ពុជា និងកាតព្វកិច្ចសិទ្ធិមនុស្សអន្តរជាតិ ។

២. បញ្ឈប់ការគំរាមកំហែង ការធ្វើទុក្ខបុកម្នេញ និងសម្ពាធផ្នែកច្បាប់ជាបន្តបន្ទាប់ ដែលមានគោលដៅលើថ្នាក់ដឹកនាំគណបក្សប្រឆាំង សកម្មជនសង្គមស៊ីវិល មេដឹកនាំសហជីពឯករាជ្យ និងអ្នកសារព័ត៌មាន ជាពិសេសការប្រើប្រាស់ប្រព័ន្ធតុលាការជាឧបករណ៍ដើម្បីបំបិទមាត់អ្នកដែលហ៊ានបញ្ចេញមតិ។ បញ្ហាអធិបតេយ្យជាតិ ដូចជាវិបត្តិព្រំដែនកម្ពុជា–ថៃ មិនគួរត្រូវបានដកចេញពីសិទ្ធិសេរីភាពក្នុងការបញ្ចេញមតិ ដែលត្រូវបានធានាដោយរដ្ឋធម្មនុញ្ញ និងច្បាប់អន្តរជាតិឡើយ។

៣. អនុវត្តឱ្យបានពេញលេញនូវអនុសាសន៍ទាំង ២០ របស់អ្នករាយការណ៍ពិសេសអង្គការសហប្រជាជាតិ ជាពិសេសអនុសាសន៍ដែលផ្តោតលើការបង្កើតលក្ខខណ្ឌផ្នែកច្បាប់ និងនយោបាយ ដែលចាំបាច់សម្រាប់ការបោះឆ្នោតដោយសេរី ត្រឹមត្រូវ បរិយាបន្ន និងគួរឱ្យទុកចិត្ត។ លើសពីនេះ KMD សូមអំពាវនាវឱ្យសហគមន៍អន្តរជាតិភ្ជាប់ការចូលរួមផ្នែកការទូតរបស់ខ្លួន រួមទាំងក្នុងកិច្ចប្រជុំកំពូល OIF នាខែវិច្ឆិកាខាងមុខ ទៅនឹងការបញ្ឈប់ជាបន្ទាន់នូវការរំលោភបំពានធ្ងន់ធ្ងរទាំងនេះនៅក្នុងប្រទេស។

KMD សូមបញ្ជាក់ថា យើងបានត្រៀមខ្លួនជាស្រេចក្នុងការសហការយ៉ាងពេញលេញជាមួយអាណត្តិរបស់អ្នករាយការណ៍ពិសេស។ យើងនៅតែប្តេជ្ញាគាំទ្ររាល់កិច្ចខិតខំប្រឹងប្រែងដែលឈរលើគោលការណ៍ ដើម្បីលើកកម្ពស់សន្តិភាព យុត្តិធម៌ ការផ្សះផ្សាជាតិ និងកសាងប្រទេសកម្ពុជាមួយដែលជាកម្មសិទ្ធិរបស់ប្រជាពលរដ្ឋគ្រប់រូប មិនមែនសម្រាប់តែគ្រួសារគ្រប់គ្រងតែមួយនោះទេ ហើយធានាការគោរពយ៉ាងពេញលេញចំពោះសិទ្ធិជាមូលដ្ឋាន និងសេចក្តីថ្លៃថ្នូររបស់ប្រជាជនកម្ពុជាទាំងអស់។
